1Acceptance of Terms

By downloading, installing, or using the JalDrishti mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you") and KRMR Solutions Private Limited ("Company," "we," "us," "our"), a company incorporated under the laws of India, with its registered office at 22nd Rd, Subash Midc, Subhash Nagar, Andheri East, Mumbai, Maharashtra 400093, India.

2Description of Service

JalDrishti is an AI-powered groundwater detection application that provides estimated groundwater analysis reports based on satellite imagery, geological data, and terrain analysis. The App is designed to assist farmers and landowners in India in making preliminary assessments of groundwater potential at specific locations.

3Important Disclaimer — AI-Generated Estimates

3.1 No Guarantee of Accuracy

The App provides indicative estimates of groundwater depth, quality, and availability. These estimates may vary from actual ground conditions. Groundwater conditions are influenced by numerous factors including seasonal rainfall, geological formations, human activity, and climate change — many of which may not be fully captured by available data.

3.2 No Guarantee of Water Availability

We do not guarantee that water will be found at any location analyzed by the App. Actual groundwater availability can differ significantly from AI-generated predictions.

3.3 Drilling Decisions

4Limitation of Liability

4.1 No Liability for Drilling Outcomes

KRMR Solutions Private Limited, its directors, officers, employees, and agents shall NOT be liable for:

• Any financial losses arising from drilling decisions made based on the App's reports.
• Dry bore wells or wells with insufficient water yield.
• Water quality issues at drilled locations.
• Any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of the App or reliance on its reports.
• Equipment damage, property damage, or personal injury related to drilling activities.

4.2 Maximum Liability

To the maximum extent permitted by applicable law, our total liability to you for any claims arising from or related to the use of the App shall not exceed ₹100 (Indian Rupees One Hundred only).

4.3 Indemnification

You agree to indemnify and hold harmless KRMR Solutions Private Limited from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App or any drilling or construction decisions made based on the App's reports.

5User Accounts

5.1 Account Creation

You may use the App by signing in with your Google account, Apple ID, or as a Guest user. By creating an account, you represent that you are at least 13 years of age, the information you provide is accurate and complete, and you will maintain the security of your account credentials.

5.2 Guest Access

Guest users may access core features of the App without creating an account. Report history for guest users is stored locally on the device and may be lost if the App is uninstalled or device data is cleared.

5.3 Account Responsibility

You are responsible for all activity that occurs under your account. Notify us immediately at support@jaldrishti.com if you suspect unauthorized access to your account.

6Acceptable Use

You agree NOT to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, decompile, or disassemble the App.
• Distribute, modify, or create derivative works based on the App.
• Use the App to provide commercial geological survey services without written permission from KRMR Solutions.
• Interfere with or disrupt the App's servers, networks, or infrastructure.
• Use automated scripts, bots, or scrapers to access the App.
• Misrepresent AI-generated reports as professional geological surveys.
• Share reports with misleading claims about their accuracy or origin.

7Pricing and Free Use

7.1 Free for Personal Use

JalDrishti is currently offered free of charge for personal, non-commercial use by farmers, landowners, and individuals.

7.2 Changes to Pricing

We reserve the right to introduce paid features, subscriptions, or premium tiers in the future. Any such changes will be communicated to users in advance through the App. Existing free features at the time of any pricing change will remain free.

7.3 Commercial Use

Use of JalDrishti for commercial purposes — including providing paid groundwater survey services to third parties using the App's reports — requires prior written authorization from KRMR Solutions Private Limited. Contact us at support@jaldrishti.com for commercial licensing inquiries.

8Intellectual Property

8.1 Ownership

The App, including its design, code, AI models, algorithms, graphics, icons, and content, is the intellectual property of KRMR Solutions Private Limited and is protected by applicable copyright, trademark, and intellectual property laws.

8.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal device in accordance with these Terms.

8.3 Report Ownership

Reports generated by the App are provided for your personal use. You may share individual reports freely. However, systematic collection, redistribution, or commercial sale of reports is prohibited.

9Account Termination

9.1 Termination by You

You may stop using the App at any time by uninstalling it from your device. To delete your account and associated data, contact us at support@jaldrishti.com or visit jaldrishti.com/delete-account.

9.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms, abuse of the App or its services, fraudulent or suspicious activity, or requests from law enforcement or government agencies.

9.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Locally stored data will remain on your device until you uninstall the App. Cloud-stored data associated with your account will be deleted within 30 days of termination.

10Third-Party Services

The App integrates with third-party services including Google Maps, Firebase, Google Sign-In, and Apple Sign-In. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party services.

11Availability and Modifications

11.1 Service Availability

We strive to keep the App available at all times but do not guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control.

11.2 Modifications

We reserve the right to modify, update, or discontinue any feature of the App at any time without prior notice. We may also update these Terms from time to time. Continued use of the App after changes to the Terms constitutes acceptance of the updated Terms.

12Governing Law & Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

12.2 Jurisdiction

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

12.3 Dispute Resolution

Before initiating any legal proceedings, you agree to attempt to resolve disputes informally by contacting us at support@jaldrishti.com. We will endeavor to resolve complaints and disputes within 30 business days.

13Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and KRMR Solutions Private Limited regarding the use of JalDrishti and supersede any prior agreements or communications.
